These Terms apply to the website located on www.triptorace.com ("Website", "App").

The Website is owned and operated by MB Sapalas, a company registered in Lithuania with its registered address at Draugystes g. 17-1, LT-51229, Kaunas, Lithuania. TripToRace is a trading name of MB Sapalas. Throughout these Terms, "TripToRace", "we", "us", and "our" refer to MB Sapalas.

By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which you can find at Privacy Policy. If you do not agree to these terms, please do not use our services.

2. General information

TripToRace is a platform that allows users to create and manage their own records, plan trip to races and track their progress. For more information, please visit our website at www.triptorace.com.

You may use our App provided you are at least 18 years old. We may delete your account if you are under 18 years old.

We may add or disable features of our App at our sole discretion.

3. App functionality

We may make updates to the App from time to time to add or adjust features or fix bugs. We are not liable for any loss or damage caused by any updates to the App or connectivity issues by factors outside our control.

Like with all applications, App may include bugs and other errors. While we strive to ensure that the App is as accurate and reliable as possible, we cannot guarantee its absolute accuracy or reliability.

App include third party services, such as Google Maps, that we do not control. We are not liable for any loss or damage caused by any third party services.

4. Use of Services

You may use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To copy, reproduce or otherwise make available any of the contents of the Site or the Apps in any form or by any means
• To gain access to App systems or engage in any activity that interferes with or impairs the performance or security of App’s networks and systems;

5. Subscriptions

There is a free trial available to our App. It may only be used once and by first time users only. The free trial period will last for the period of time specified. After the free trial period or when subscribing to a paid plan, you will be required to select monthly or annually subscription plan. Your subscription can be modified or cancelled at any time.

6. Payments & Refunds

We accept payments through Stripe. You can cancel or modify your subscription at any time. If you cancel your subscription, you will not be charged again for the current period.

Payment for your subscription will be processed through Stripe and will be charged to your credit card or other payment method you have provided to us. Payment will be charged according to the plan you have selected (monthly or annually).

You can stop or modify your subscription payments at any time in your account subscriptions page. Once you cancel your subscription, you will still be able to use App for the remain of your subscription period. No refunds are available.

Refunds

We may terminate your subscription if you are not using it in a lawful manner or if you are not complying with these Terms. We will contact you via email to inform you of the termination and we will explain why the cancellation or closing of your account was necessary.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of TripToRace. The Service is protected by copyright, trademark, and other laws.

8. Limitation of Liability

In no event shall TripToRace, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Termination

If you breach these Terms, we may terminate your account at any time without prior notice. We will notify you via email of the termination and explain why the cancellation or closing of your account was necessary. You will not be entitled to a refund of any payments you have made to us.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

11. Other Terms

By using our Service, you confirm that you are not a citizen or resident of any country that is subject to sanctions by the United States or EU countries or not a resident of any country listed as "terrorist supporting" country.

You concent to receive communications from us electronically. You consent that all notices, disclosures and any other communications that we provide to you electronically satisfy any legal requirements that such communication is in writing.

12. Dispute resolution

In the event of a dispute between you and TripToRace, you and TripToRace agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations, the dispute will be subject to the exclusive jurisdiction of the courts of Lithuania.
